A federal judge has denied Apple the ability to request a preliminary injunction against the FBI’s new iOS encryption rules for the iPhone that belonged to the San Bernardino shooter.
In an order issued by U.S. District Judge Sheri Pym, Apple can file for a stay at any time, but the court is not inclined to do so.
“Defendant has had a considerable time since its motion for judicial notice, and the record contains no significant evidence demonstrating that the parties have reached a common determination,” Pym wrote Tuesday.
Pym declined to delay allowing the FBI to take the necessary steps — such as requiring an end-to-end passcode to access the device’s data — until the court decides whether it may grant an emergency restraining order, which would delay Apple’s ability to access the data until the case is resolved. Apple is already able to access encrypted data when requested to do so by investigators.
In April, the DOJ asked a federal judge, William Alsup, to bar Apple from obtaining the government’s permission to unlock the iPhone used by Syed Farook and Tashfeen Malik. The companies say the FBI wants to decrypt other devices as well.
Apple didn’t immediately return a request for comment on Pym’s decision.
